Know who did?

I would be grateful for any hints leading to the original creator(s) of this work. I think it makes a fascinating study in photographic mash-ups, copyright, creative commons and remix culture in general.

UPDATE:

Thanks to some great detective work by Graham and Leo we now know that the photo was taken by Mark Khademi from Milson’s Point and that it was featured in online galleries by both the BBC and the Australian (which could well account for all the un-attributed e/mail that followed). So Mark, if you are reading this, I would love to know if you are cool with the re-use of your image and if you can shed any light on the first person to re-mix it by adding the large lizard.

I am trying to track down an attribution chain to the person who took this photo and the first person to photoshop it (adding ye olde lizard). I first saw “Godzilla – Sydney Dust Storm – by Julia” on Flickr

It kinda freaked me out because it reminds me of a print of the image below I have behind my desk (which has a story of its own).

A further clue is given by – rahsoft, ah, thanks for the tip. i got the original in the same email… taken with a Nikon D60 at 07:40 GMT+10!

This video of Professor Tanya Monro featured on the AdelaideNow website contains re-mixed footage shot by other people! This is a VERY GOOD THING which represents the first fruits of something I have beeen trying to achieve for a very long time.

Over a year ago, I convinced Prof. Monro to fund the shooting and purchase of some video footage that we could publish online with an open license. This effectively grants PERMISSION IN ADVANCE to anyone who might want to re-use that material. Up to now, the only person who has actively re-used this footage is me, preparing educational and promotional resources for the University of Adelaide.

So, what are some of the things I have been trying to achieve?

Leadership in appropriate strategies for re-use of digital material in the context of online social media

Promotion of some excellent research by passing interesting stories through social networks

Efficiency in the very costly process of creating effective digital stories

Protection of valuable brand and IP assets through careful selection to manage risk

Prototype an ecosystem for multi-generational re-mix of digital assets for both research and teaching & learning

How does this early example of re-mix rate against my lofty goals? I’d say we score 6/10 based on the following criteria:

Efficient – at short notice we conducted brief interviews & provided links to existing footage with minimal disruption to labs

Effective – a good, new story has been created and shared on a high traffic site

Correct – appropriate footage was re-used (in fact, some of it was ’second-generation’ that is based on footage that was already re-mixed)

Social – passing links to the video through twitter and facebook resulted in a measurable increase in views of the video in a very short time period (from 10 to 40 at the time of writing, within hours of publication). Compare this to the average of 0-5 views of other videos published on the same site, earlier on the same day.

On the down-side we missed out on:

Attribution – the only requirement stipulated by our open (cc:by) license is that some form of attribution is given to the source of content. Ideally this would take the form of a hyperlink like this: “video materail courtesy of Prof. Tanya Monro“

Possibility of future Re-Mix – the streaming video on AdelaideNow site is difficult to download and is locked up under Copyright (i.e. not openly licesed). This means that this story will die when the video ‘ages off’ the AdelaideNow archive. Furthermore it is effectively sterile and very unlikely to ‘re-produce’ because of the restrictions just mentioned.

How could we do better next time?

Attribution – it would be enough to mention the names of contributors to successive generations of video content in some form of credits in the video itself. For example video courtesy of Mike Seyfang, Rob Morrison and Tanya Monro covers it. Better still, hypertext links in the copy surrounding the video might reward the contributors with visits to their websites, downloads of their material and possibly further re-mix of their work. That could be achived in a simple sentence “video courtesy of Mike Seyfang, Rob Morrison and Tanya Monro .” Even better still something like:

Derived from video by Mike Seyfang, shot by Rob Morrison , courtesy of Tanya Monro.
Derived from video by Mike Seyfang, shot by Rob Morrison , courtesy of Tanya Monro.

Downloadable for easy re-mix – in addition to the streaming video, provide links to easily downloadable versions in appropriate formats for editing. For example this version of the ‘GreenBeamMeUp’ sequence is available as medium resolution quicktime and mpeg-4 while this version of it can be downlaoded as high resolution DV-Video (which is how it was shot). p.s. As a side note – trying to prevent downloads by only offering streaming video is a complete joke. Worse still the futile act of crippling the content with DRM locks and the like.

Open License – granting permission in advance to would-be re-mixers is a very potent thing to do. The cc:by (Creative Commons, Attribution) license granted to carefully selected material from Prof Monro’s labs places only one restriction on future re-mix – that of giving some form of Attribution. As re-mix culture evolves, I predict that any material not licensed as openly as possible will rarely be discovered, seldom re-mixed and will therefore dissapear out of culture over time. Notice what happens in the advanced search tabs of google and flickr – when selecting material you are free to re-use and modify, even for commercial purposes, only the most openly licensed material is returned in the search results. Think about the impact of that.

<cuss-warning>

Since my earliest tinkerings with the social web, I have thought the digital trails we write to the internet would make ideal data for anthropologists to study. My instincts regularly ‘give me feelings’ that the things I experience through my online networks are profound and perhaps mirror the inner workings of my brain or maybe even an ant colony. I have often wondered what a scientific study of the digital tracks left by my blog posts, comments, flickr images, video mashups and most recently twitter tweets might do to re-enforce or de-bunk my intuition.

Having had the privilege of hanging out with Microsoft’s chief anthropologist Anne Kirah after a presentation I gave a few years back got me thinking about what people in her field of research would make of this data.

Then, just before the US Election I discovered ‘cursebird‘ through a very *serendipitous tweet exchange with JP (the 5th beatle of the Cluetrain Manifesto and oracle of all things online and social):

Which really showcased (to my warped mind anyway) how an open set of API’s on a bunch of data from people thinking out loud (140 characters at a time) can reveal much to a half-crazed pseudo-scientist. Here are my first quickly jumped to and almost fact free conclusions:

My hand picked twitter network (following just under 100 people I actually ‘know’) are not as obsessed as the general twitterverse with US elections BUT… I can not recall seeing one pro-republican tweet in the midst of much pro-obama rehetoric. Makes me wonder if I should apply my ’subscribe widely’ ethos to my twitter followers to avoid the echo-chamber.

The swearing twitterverse was swamped with the meme ‘dont fuck it up america’ in the hours leading up to the US election. It seemed that these messages came from both within and outside the US of A – some of them from my own network. There seemed to be a real push for action intended to spur Americans to get out and vote democrat.

Just after Obama claimed victory the swearing twitterverse resonated with “<insert random expletive here> we won!” My own network contained several emotional and positive references to Obama’s victory speech and seemed to echo a sentiment of a new era of hope.

Within hours the hope had evaporated for some when the LA gay marriage vote went down and the odd cynical self proclaimed expert touted ‘Obama voted against gay marriage and is therefore a hypocrite’ – end of hope). Fascinating stuff!

I tried to go back and collect some cursebird screenshots as evidence but alas, I’m too late. At least one punter out there shares some of my enthusiam for cursebird’s window into the global brain.

This morning I woke up with a bunch of cursebird inspired titles for possible future blog posts:

Twitter, cursebird and the Anthropologist

Twitter, cursebird and the US-Centric echo chamber of the social web.

Twitter, cursebird and ‘instant karma’ by scatterbrain

Cursebird shits on my clean feed (showing how to subvert pornfilter into a pornfinder)

Over the weekend several people alerted me to the fact that someone had ’stolen’ my logo.
Turns out that Richard McManus had (rather skillfully in my opinion) used one of my flickr images in a post on the ReadWriteWeb blog.

And that’s fine because I decide to ‘give away’ most of my rights to my digital content in the hope that someone will find it useful and re-use it to tell their story. No need to ask, just be polite and give me attribution (which Richard did by linking to my ‘mikeblogs‘ flickr account). That’s what:

cc:by or ‘Creative Commons – Attribution’ means.

Sure, Richard could have made me look stupid – but I do a pretty good job of that myself.

Sure, he could make money off that post – good luck to him, he did the hard work.

Either way I gain more than I lose by having my work re-mixed into a new context. Had I licensed my work in a more restrictive way (say cc:by-nc-sa which means reuse must be non commercial and licensed in exactly the same way) it is unlikely that anyone would have found it, let alone re-used it.

I’m guessing here, but I suspect that Richard used the advanced search in flickr and decided only to look for images about ‘readwriteweb’ that he is free to use for commercial work, with modifications. Images licensed with more restrictions would simply not be displayed in the search results.

This is why only work that is freely licensed with continue to be relevant in future culture (but that is a rant too long for the short amount of time I have before sleep time).

Some other places you will find derivatives of my image:

http://fang.blip.tv/file/633462/ – a presentation that helped my create an excellent job
http://fang.blip.tv/file/105776/ – a mashup of Lessig and Downes that they have both seen
http://www.flickr.com/photos/mikeblogs/323586161/ – my entry in a creative commons competition
http://www.flickr.com/photos/cambodia4kidsorg/306021623/in/pool-ccswagcontest06 – an entry by the winner of that creative commons competition
http://www.flickr.com/photos/cambodia4kidsorg/300492293/in/pool-ccswagcontest06 – the original image from which I borrowed the cc:frisbee
http://flickr.com/photos/31477768@N00/227948364 – my original hand drawn diagram
seyfang, mikeseyfang

I am working on an interesting video project with the edna team. Our esteemed leader, Mr John Travers has issued a ‘grassroots video challenge’:

If you have a go, you will in return get my undying respect, affection and gratitude not to mention professional regard at being a venturesome person. I have made a little invitation example here, http://video.google.com.au/videoplay?docid=3698243344429972742&hl=en-AU that on reflection, is too long and tedious, but you will see, sets the bar for technical standards nice and low. You will see a couple of other efforts I have put on Google Video.

Here is my response.

Enjoy

So, should I feel flattered or ripped-off that a for profit business included one of my flickr photos from Glenelg beach in a travel site?

Well, let me tell you – I take it as a compliment and this is EXACTLY why I license my stuff cc:by not cc:bync or anything sharealike. To me, it is the greatest form of flattery to have my digital work remixed into new work that gives it a greater chance of surviving as culture evolves. Just last week, I was honoured to have one of my podcast episodes sliced up and pushed forward. I’m certainly no artist, but my kids just might be and I think it is important for me to test out and model smart ways to live and work in the digital, read/write world.

It is quite likely that the people searching for relevant photos to include in schmap used something like the ‘advanced search’ in flickr to find images they could use without asking permission:

Stuff licensed cc:by,nc or cc:by, nd just doesn’t show up in a search like that.

Furthermore, the people from schmap have created a little process that I think is quite smart, first they e/mailed me so that I could ‘opt-in’ for possible inclusion. Then the followed up with a ‘you have been successful’ (a little cheesy but not too bad) e/mail which included a permalink to their use of my work in context. I think this is very smart and a good example of the way things should be. Even though I deliberately relinquished some of my ‘rights’, the consumers of my digital content took ‘responsibility’ to make sure I was happy with what they intended. And look what happened, I responded by writing this blog post that will pass forward some of the link love they have shown to me.

Everybody wins.

Nobody loses.

Comments please?

I just love the fact that the podcast Dave and I do breaks all the rules and continues to reward us for doing so. The honour of hanging out with one of the brightest people on the planet is reward enough in itself, but sometimes little jewels pop out of the long tail. Yesterday I was extremely flattered to notice (via facebook) that Biff Naked had taken the liberty of publishing a small snippet of one of our episodes on his blog.

Why is this important:

This is a foretaste of the future of media and of language

danah boyd says it better than I can, so I have taken the liberty of messing with her fireside chat with Mark Pesce – PLEASE take a LISTEN.

allowing consumption to become production taking stuff and muck with it and spit it back out…

what would happen if we gave students free range to remix and muck with our politicians YouTube videos (and indeed everything they see on any screen) ?

we need to work hard to digitize and legalise access to the soundtracks and movies that shaped our lives so that we can muck with them and speak them into the future of culture

Stephen Downes clued me into this a few years back when he spoke of the ‘post linguistic and sub symbolic’ nature of mashing up bits of people’s audio with images, text and video. That’s what inspired me to muck with his podcast (and prof lessig’s) to produce THIS video mashup. It’s the reason why I stayed up way too late one monday night to muck with danah’s first talk in Australia.

So thank you Mr. Biff – I’m flattered. The episode you listened to and sliced up was the most extremely rambly and long ‘thinking out loud’ session Dave and I have ever done. In fact, we both discussed cutting it down to less than one hour – glad we didn’t. Looking forward to meeting you on a future episode of extraordinary.thepodcastnetwork.com.

Leigh opened the webheads online convergence conference with his keynote talk by stepping outside his comfort zone, into the perilous waters of copyright. Leigh explains some of the unexpected restrictions that come in to play when trying to license digital content in an open way – from the point of view of a learning institution.

It’s hard going but well worth a listen and ongoing conversation. I have run into the same pain points that Leigh describes in my work with LearnDog. Having done a few rounds of this conversation myself, I thought I would try to summarise some key points:

cc:by (attribution) is a good starting place for open content in the Creative Commons world

cc:nc, sa (non-commercial and share-alike) seem to ‘add open-ness’ but actually bring surprising restrictions in a number of circumstances

things get really messy when learners and educators try to re-use (remix) content, especially when hosted on commercial platforms with intrinsic license constraints

the whole debate could go away – if the default position were non-commercial sharing: as Stephen Downes has said about Creative Commons:

it shouldn’t be necessary; the default should be non-commercialsharing, while commercial ownership and use constitute exceptions)

I can almost see the day when all digital work that is subject to copyright will fade from view. Those brilliant lawyers and middle managers from the music industry here in Aus have just sped the process considerably:

The Sydney Morning Herald:

Ms Heindl said that this could apply even if a person had
embedded a copyright-infringing YouTube clip in their blog or
MySpace page.

“We don’t make any distinctions between big websites or small
websites”, she said, adding that MIPI would consider individual
blogs on a “case-by-case basis as to whether it would be
appropriate to take action”.

Ms Heindl’s message to Australians is clear: “If you are linking
to copyrighted material in an unauthorised fashion, then you can be
held liable for copyright infringement.”

It’s just to much of a hassle and dangerous to work with copyright material. Thanks to the little birdie who dropped a link to this in my Skype IM.

A big thanks to Kapn Kirk, Blakey and Antz for helping turn my crazy idea for the ‘Creative Commons Swag’ contest into a reality. The T-Shirt I ordered just in time for a rushed photo shoot and some photoshop munging. Here are my two favourites:

For those interested in the creative process, keep reading, otherwise take a quick peek at THIS SHORT VIDEO that inspired the whole thing.

Being the father of two creative teenage kids (and a bit of a digital hack / remixer myself) I was both moved and challenged by Prof Lawrence Lessig’s talk about Read/Write Culture as delivered to LinuxWorld 2006. Having listened to the Podcast several times and armed with a few hand drawn diagrams, I decided to some digital remixing of my own in an attempt to experience and work through some of the issues raised in the talk. The SHORT VIDEO referenced above is the result – featuring audio from Prof Lessig, Stephen Downes and various bits and pieces from my kids and their school friends.

When I heard about the ‘Creative Commons Swag’ contest I visualised a photo of myself presenting that video from the podium of the Microsoft Innovation Centre I helped establish a few years ago. Trouble is, the rules dictated that I be wearing some ’swag’ (e.g. T-Shirt) that I didn’t have. So, I jumped online and ordered some. While waiting for delivery to Aus, I made some images using stuff from the video, a photo of me and an image of a T-Shirt from the online store. Then, a wonderful thing happened – Beth Kanter (cambodia4kidsorg) ‘mashed me up’ – and I returned fire!

Beth, then one a weekly prize for this cute shot:

My black CC T-Shirt finally arrived, so a quick trip to the Innovation Centre so Kirk and Chris can take some pix of me onstage with various backgrounds on the big screen:

Then into PhotoShop and call for some help from my mate Tony (The Albino):

The supply/demand Triangle photo below is one of the latest products of the MashUp that is occurring in my brain since listening to Prof Lawrence Lessig’s address to LinuxWorld 2006. My original plan was to write a concise blog post (or maybe even white paper) summarizing neatly my reflections on this talk.

Instead, I have been inspired to create a whole bunch of pictures, audio, video – even machinima mashups as I try to work through the ramifications of Read Write Culture. I am not sure how I can (or even if I should) share this work with you. I will start by uploading what I can to ‘official’ Creative Commons sites like CCmixter and this Wiki.

The whole process has caused me to almost blow a fuse, and is really challenging my views on what is legal / ethical in the remix / mashup world, and how difficult it is to effectively adhere to the ‘Some Rights Reserved’ idea.
